Native Title Overview

 

 

Part of our vision is to "Get Back Country".

The main focus and activity of the Kimberley Land Council is in the area of native title.

As the Federal Government-recognised Native Title Representative Body for the Kimberley region, the KLC has statutory functions under the Native Title Act 1993. In accordance with these functions, it assists Aboriginal people to obtain recognition of, and fully enjoy, their native title rights and interests.

Operations of the KLC are funded primarily, but not exclusively, by the Federal Government’s Office of Indigenous Policy Co-ordination (OIPC).

 

There are a number of Native Title claims across the Kimberley.

Native Title has been recognised in nine Kimberley claims (as at January ‘07): Karajarri, Martu/Ngurrara, Miriuwung Gajerrong #1, Miriuwung Gajerrong #4, Rubibi # 6, Rubibi Combined, Tjurabalan, Bardi Jawi, and Wanjina Wunggurr Wilinggin.

Two of these determinations are subject to appeal: the Bardi Jawi appeal was initiated by the claimants, and Rubibi Combined appeal was initiated by the State Government of Western Australia. Decisions in both these appeals are expected during 2007.

There are a number of other claims registered with the National Native Title Tribunal. Many of these claims are closely related to the existing successful claims.
